DMCA Policy

TheWorldCamping.com respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy for handling copyright infringement claims.

1. DMCA Notification

If you believe that material available on TheWorldCamping.com infringes your copyright, you may submit a written notification to our designated DMCA agent. To be effective, the notification must include the following:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  • Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and email address.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Counter-Notification

If you believe that your material was removed or access to it was disabled by mistake or misidentification, you may submit a counter-notification to our designated DMCA agent. To be effective, a counter-notification must include the following:

  • A physical or electronic signature of the user.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • The user’s name, address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the user’s address is outside of the United States, for any judicial district in which TheWorldCamping.com may be found, and that the user will accept service of process from the person who provided notification or an agent of such person.

3. Response and Removal Process

Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material. We will also notify the user who posted the material that we have removed or disabled access to it. If a counter-notification is received, we may reinstate the material in question unless our DMCA agent receives notice from the original complaining party that a court action has been filed to restrain the alleged infringer from engaging in infringing activity related to the material on TheWorldCamping.com.

4. Repeat Infringers

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
